When selling residential property, my services as an experienced real estate attorney can make the transaction proceed smoothly and efficiently minimizing worries or concerns on your part. As your representative, I will review your sales contract to be certain nothing has been omitted or included which is not in your best interest. Typically, a buyer’s offer will include contingencies for Attorney review, professional home inspection, mortgage contingency and possibly a contingency for the sale of your buyer’s current residence. Each one of these contingencies will be timely monitored and status will be reported to you. Ineffective handling of these matters can have significant negative outcomes. This will not happen if I am representing you. I will also order a title insurance commitment which identifies any restrictions, liens, mortgages, and tax status for your property. Sometimes you may not realize there are recorded instruments or tax deficiencies on your property title. I can assist you in removing any liens and encumbrances so that your purchaser will be able to take free and clear title of the property you are selling. I will prepare the necessary closing documents and attend the closing to assure you receive the appropriate proceeds. Your attendance at the closing is generally not necessary and the proceeds can be wired or delivered at your direction.
When you retain my services, I would like:
A copy of your contract.
Your current deed and/or title policy from when you purchased.
Your current lender information including the name of any mortgage holder(s), account number(s), and phone number(s).
A current survey, if available.
If a condominium, the name, address, and phone number of the management company for the Association or the Association officer (usually Treasurer) who handles the transactions for a self-managed building.
If the above information is not available, we will still be able to conclude the transaction.
For Residential Buyers
Buying a home, whether it’s your first time or you are a veteran, is an important investment and lifestyle change. My services on your behalf can make sure the property is what you expect and your move will go as scheduled. Beginning with the contract attorney review period and home inspection contingency, my office will be in regular contact with you. Any contract modifications I believe will be in your best interest will be reviewed with you and requested of the seller. As a general rule, you will be entitled to a professional home inspection normally arranged by your realtor. I will review the results of the inspection, offer guidance as to what is reasonable to request for repair or replacement, and correspond with the seller’s attorney to resolve these issues or obtain an appropriate credit towards the purchase price. Your contract will also typically contain a mortgage contingency which gives you a certain period of time to obtain an unconditional commitment from your lender. My office will monitor your lender’s processing of your application to be certain all deadlines are met or the appropriate time extension is requested. Once your loan is approved we will proceed to schedule the closing and review the title insurance commitment from the sellers. I will attend the closing to be sure the seller’s transfer documents are correct, the lender’s documents are what you expect and were promised and that the title to the property will transfer to you free and clear of any liens or encumbrances other than building code restrictions and easements.
